\nFollowing the denial of their proposals, a Bukit Timah condominium owner and a group of 22 owners of 12 SunGlade condo units in Serangoon brought their cases with their respective management corporations (MCs) to the Strata Titles Board (STB), reported The Straits Times.
\nNotably, the Bukit Timah home owner wanted to install \u201cinvisible\u201d grilles at his balcony to protect his young children, while the Serangoon condominium owners wanted to cover the trellises in their balconies.
\nWhile the STB has resolved the spat with the nine ground floor units at SunGlade condo, with the MC finally agreeing to cover the trellises to prevent killer litter, it rejected the applications of the owners of three units on the 13th floor.
\nThis comes as the wall to be used was maintained by the MC, hence, considered common property.
\nIn denying the applications of the owners, the STB said \u201can order granted by the Board would equate to the Board ordering the (MC) to permit the applicants to have right to exclusive use of the common property for an unlimited period of time\u201d.
\nMeanwhile, the STB has overruled the MC of the Nineteen Shelford Road, saying that it failed to give the owner \u201cpractical and feasible alternatives\u201d when it denied its proposal to install \u201cinvisible\u201d grilles at his balcony.
\nSituated at the top floor of the four-storey building, the unit\u2019s balcony features railings with 20cm gaps between each horizontal bars \u2013 posing a safety hazard to the owner\u2019s young children.
\nThe unit owner\u2019s lawyer noted that the decision of the STB \u201caffirms the legal position that safety is paramount\u201d.
