\nDevelopers are contractually obliged to fix any defects in new EC projects within the Defects Liability Period.
\nPrivate developers of executive condominiums (ECs) are responsible for all defects and design flaws in newly built projects, revealed the Ministry of National Development (MND) in Parliament on Tuesday (7 February).
\nThis is because buyers bought their EC units directly from developers, and the Sale and Purchase (S&P) Agreement signed between home buyers and developers provides that the latter will be responsible for any defects reported during the 12-month Defects Liability Period.
\n\u201cThe EC developer is also contractually obliged to attend to all feedback from buyers on the design, finishing, workmanship or other concerns pertaining to the development, and respond to the buyers accordingly,\u201d noted the MND.
\nIntroduced in 1995, the Executive Condominium Housing Scheme (ECHS) aims to meet Singaporeans\u2019 aspirations to own private homes in an affordable way.
\nThis is achieved by imposing ownership restrictions and certain initial eligibility requirements on EC buyers. After the 10th year, however, the restrictions are lifted, making ECs no different from other private condos, said the MND.
